Terms & Conditions for Lovechild

1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of the website ("Site"), mobile applications ("Apps"), and any related digital or physical services, content, features, and offerings provided by Lovechild, a California-based hospitality and entertainment company ("Lovechild," "we," "us," or "our").

By accessing, browsing, or using the Digital Properties, or attending any of our events or locations, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you must not use our services.

Our Digital Properties are not directed to children under the age of 13. If you are under 13, you may not use the Site or submit any personal data through our services.

4. Acceptable Use and Conduct

You agree to use our Digital Properties and services only for lawful purposes and in accordance with these Terms. You are strictly prohibited from:

• Using any automated system, such as bots, spiders, or scrapers, to extract data.

• Attempting to reverse engineer, decompile, or disassemble any part of our services.

• Submitting false or misleading information.

• Impersonating any individual or entity.

• Engaging in any conduct that restricts or inhibits anyone’s use or enjoyment of the site.

• Uploading or distributing viruses, malware, or any harmful content.

• Using our content, trademarks, or data for training artificial intelligence or machine learning models.

Any unauthorised use of the Digital Properties will result in immediate termination of your access rights.

5. Intellectual Property Rights

All content, design, text, graphics, logos, icons, images, audio clips, video, digital downloads, data compilations, software, and other material ("Content") on our Digital Properties are owned or licensed by Lovechild and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may access and use the Content for personal, non-commercial use only. You may not:

• Reproduce, republish, distribute, or exploit any Content for commercial gain.

• Modify or create derivative works from the Content.

• Use any trademarks or logos without express written permission.

All rights not expressly granted are reserved by Lovechild.

6. Bookings, Reservations, and Payment Terms

Lovechild offers reservations and event ticketing for various hospitality and entertainment services. The following terms apply:

• All bookings are subject to availability and confirmation.

• Full or partial payment may be required at the time of booking.

• Payments are non-refundable unless otherwise stated in the specific event terms.

• Cancellations must be received at least 48 hours prior to the event to be eligible for a refund, unless stated otherwise.

• No-shows and late arrivals may result in forfeiture of your reservation without refund.

We reserve the right to refuse or cancel bookings at our discretion.

7. Special Event, Alcohol, and Venue Terms

Age-Restricted Events: Lovechild hosts events for adults 21 years and over. You must present a valid government-issued ID upon entry. No refunds will be given for failure to provide ID.

Alcohol Service: Alcohol is served in compliance with California Department of Alcoholic Beverage Control (ABC) regulations. Lovechild staff reserve the right to refuse service to anyone for any reason, including suspected intoxication or inappropriate behavior. Outside alcohol is not permitted.

Live Entertainment: Performances and event programming are subject to change. Lovechild is not responsible for last-minute lineup changes. Ticket purchases are non-refundable unless the event is cancelled.

Venue Rentals: Private events and venue hires require a written agreement. Clients are responsible for:

• Obtaining necessary permits and insurance.

• Respecting capacity limits.

• Covering damages and additional cleanup.

• Complying with city ordinances, including noise and curfew laws.

Noise and Compliance: All events must adhere to applicable local sound and nuisance laws. Failure to comply may result in termination of the event.

8. User Content and Submissions

If you submit, upload, or share any content (e.g., reviews, photos, messages), you grant Lovechild a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display such content in connection with our business.

You affirm you have all rights to submit the content and that it does not violate any laws, third-party rights, or our standards.

9. Links to Third-Party Sites

Our Digital Properties may contain links to third-party websites. These are provided for convenience only. Lovechild does not control or endorse the content or practices of such websites, and we assume no liability for your use of them.

10. Privacy and Security

We collect and process your personal data in accordance with our Privacy Policy. By using our Digital Properties, you consent to such collection and processing. We also use cookies and tracking technologies as explained in our Cookie Policy.

11. Limitation of Liability

To the maximum extent permitted by law, Lovechild disclaims all liability for:

• Loss of profits, business, or data;

• Personal injury, property damage, or other harm resulting from your use of the services;

• Bugs, viruses, or other harmful elements;

• Interruption of service or content inaccuracies.

Our total liability shall not exceed $100 USD under any circumstances.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lovechild, its officers, employees, agents, and affiliates from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from your use of our services or your breach of these Terms.

13. Termination

We may suspend or terminate your access to our services at any time, without notice or liability, for any reason, including if you breach these Terms. You may also terminate these Terms by discontinuing your use of our services. Sections relating to IP, liability, indemnification, and dispute resolution will survive termination.

14. Force Majeure

Lovechild is not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, power failures, strikes, pandemics, civil unrest, or governmental restrictions.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California and applicable federal law. Any disputes arising from or related to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.

16. Arbitration and Class Action Waiver

Any disputes or claims between you and Lovechild shall be resolved through binding arbitration administered by JAMS or AAA. You agree to waive any rights to pursue disputes in court or as part of a class action.

Arbitration will take place in Los Angeles County, California, unless otherwise mutually agreed. Each party is responsible for its own legal fees.

If any portion of the class action waiver is found unenforceable, the dispute will be resolved in court.

17. Miscellaneous

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

Transfer: We may transfer our rights and obligations under these Terms without your consent.
